GENERAL TERMS AND CONDITIONS
Provider of hosting and server services BlazeHost.cz.
Effective from: October 1, 2026.
1. INTRODUCTORY PROVISIONS
1.1. Provider: Jiří Viták, a sole trader, Company ID: 21766177, registered office at Ametystová 702/46, 153 00 Prague 16 – Radotín, Czech Republic, registered in the trade register kept by the Municipal Office of Prague 16, Trade Licensing Department, not a VAT payer. Contact: [email protected], +420 910 114 397.
1.2. Customer means a natural or legal person who has created a customer account in the client area (billing.blazehost.cz). A Consumer is a customer who is a natural person not acting within their business or profession; a Business is any other customer. Provisions expressly applying to Consumers do not apply to Businesses.
1.3. By registering, the Customer confirms that they have read these Terms and the Privacy Policy and agree with the Terms. The Provider keeps a record of the version the Customer agreed to. The Privacy Policy and, where the Customer processes personal data within the service, the Data Processing Agreement (billing.blazehost.cz/terms/dpa) form part of the contract.
2. SERVICES
2.1. The Provider offers in particular game servers (Minecraft, FiveM), Discord bots, virtual servers (VPS), Cloud VPS, webhosting, dedicated servers, domain registration and renewal, and related add-on services (for example an additional IPv4 address for a VPS).
2.2. The servers running the services are located in the firstcolo FRA4 datacentre in Frankfurt am Main, Germany. Game servers, Discord bots, VPS, Cloud VPS and webhosting are set up automatically, usually within minutes; dedicated servers are activated manually after the Provider reviews the order.
2.3. The Provider provides services with professional care. It does not publish a Service Level Agreement and does not guarantee a specific availability percentage; availability is measured and published at status.blazehost.cz. Planned maintenance is announced at least 24 hours in advance by email and on Discord.
2.4. DDoS protection is provided by an external connectivity and traffic filtering provider (dataforest GmbH) with a filtering capacity of 7.4 Tbps at the network layer (L3/L4); it is always on and included in the price. Application-layer (L7) protection is not provided. The Provider does not guarantee that every attack will be mitigated and may temporarily limit traffic to a targeted IP address if an attack endangers the infrastructure or other customers.
2.5. The Customer is responsible for backing up their data unless the description of a specific service states otherwise. For game services (game servers including FiveM, Discord bots and webhosting) the Provider makes an automatic backup once a day at night and keeps backups for the last 5 days, for all plans alike; for FiveM servers the MySQL database is backed up together with the files. Manual backups can be created in the panel up to the number set for the plan. Backups are stored in the same location as the service, are not a guarantee of data recovery and are deleted together with the service. VPS, Cloud VPS and dedicated servers have no automatic backups; manual snapshots can be created for a VPS.
3. CREDIT
3.1. The Customer obtains credit mainly by topping up the account through the payment gateways offered in the client area at the time of payment (in particular GoPay; depending on the current offer also Stripe, PayPal, Mollie, MercadoPago or NOWPayments for cryptocurrency payments), or by redeeming a voucher or as a bonus.
3.2. For service prices, 1 credit equals CZK 1. The number of credits obtained and the price of the top-up are shown before payment. A receipt is issued for every top-up and is available in the client area and sent by email.
3.3. Credit is used solely to pay for the Provider's services. It is not a deposit or electronic money, bears no interest and cannot be transferred to another account. Credit obtained as a bonus or from a voucher cannot be paid out.
3.4. If a payment gateway returns a payment to the payer (refund, chargeback), the Provider deducts the corresponding credit, even into a negative balance, which the Customer must settle before ordering new services.
4. PRICES AND PAYMENT
4.1. Prices are final; the Provider is not a VAT payer. Services are prepaid: the price of each billing period (usually one month, one year for domains) is deducted from the credit at the start of the period; the first period is charged when the service is set up (dedicated servers on activation).
4.2. Services renew automatically for the next billing period until the Customer cancels them. If the credit is not sufficient for an upcoming payment, the Customer is notified by email in advance.
4.3. A price increase for a running service (except domain renewal prices, which follow the registrar's price) is announced by email at least 30 days in advance; the Customer may cancel the service before the change takes effect. A price change never affects a period already paid.
5. INSUFFICIENT CREDIT, SUSPENSION AND DELETION
5.1. If there is not enough credit at the start of a billing period, the service is suspended and the Customer is informed by email. Topping up within the grace period restores the service automatically.
5.2. After the grace period the service is irreversibly deleted including all data (and backups). The grace period is at least 7 days for VPS, Cloud VPS, webhosting and dedicated servers and at least 14 days for game servers and Discord bots; the exact period is stated in the order and in the order confirmation. The Provider warns the Customer by email before deletion.
5.3. A domain that is not renewed for lack of credit expires under the rules of the registry; regaining it may not be possible. Deleted data cannot be restored.
6. CANCELLATION AND TERMINATION
6.1. The Customer may cancel any service at any time in the client area. The service remains available until the end of the paid billing period and is then suspended and deleted after the grace period under Article 5.2; no further period is charged. The price of a billing period already started is not refunded on cancellation, without prejudice to the rights under Articles 7 and 8.
6.2. The Provider may terminate the contract without giving reasons with 30 days' notice by email; it then returns the proportional part of the price for the unused billing period as credit and, on request, pays out unused paid credit. The Provider may withdraw from the contract with immediate effect if the Customer materially breaches it, in particular the Acceptable Usage Policy.
6.3. The customer account can be closed in the client area if the Customer has no active service.
7. WITHDRAWAL AND CREDIT REFUNDS
7.1. A Consumer may withdraw from a distance contract without giving reasons within 14 days of its conclusion (Section 1829 of the Civil Code).
7.2. Credit top-up: if a Consumer withdraws within 14 days of a payment, the Provider returns the unused credit from that payment to the original payment method (or another way the Consumer agrees to) within 14 days of the withdrawal. Credit from that payment already spent on services is not returned; Article 7.3 applies to those services. Free credit (vouchers, bonuses, referral rewards) is used first and is not refunded.
7.3. Services: before ordering, the Consumer expressly requests that the service starts before the withdrawal period expires and acknowledges that the right of withdrawal ends once the service has been fully provided. If the Consumer withdraws from such a service within 14 days of the order, they pay the proportional part of the price for the period provided; the unused part of the current billing period is returned as credit. The service ends immediately and its data, including backups, is deleted without a grace period.
7.4. Domains: the right of withdrawal from a domain registration ends when the domain is entered in the registry.
7.5. How to withdraw: using the "Withdraw from contract" function in the client area next to the respective payment or on the service detail page, by email to [email protected] or by letter to the Provider's registered office; the model withdrawal form is attached to the full Terms. Sending the withdrawal before the period expires is sufficient.
7.6. Businesses (accounts with a Company ID) have no statutory right of withdrawal; the Provider decides on refunds of their unused credit individually.
7.7. Outside the withdrawal period, unused paid credit is refunded only in case of an incorrect top-up (for example a duplicate payment or a typo in the amount) requested within 7 days of the payment, termination by the Provider under Article 6.2, termination by a Consumer due to disagreement with a change of the Terms (Article 11.2), or as part of rights arising from defective performance.
8. COMPLAINTS (DEFECTIVE PERFORMANCE)
8.1. The Provider is responsible for the service conforming to the contract, its description and the law throughout its provision. For Consumers, in particular Sections 2389a et seq. of the Civil Code on digital content and digital services apply.
8.2. The Customer reports a defect without undue delay via a ticket in the client area or by email to [email protected], stating the service, a description of the defect and when it appeared. The Provider confirms receipt and handles a Consumer's complaint within 30 days of submission, unless a longer period is agreed, and issues a confirmation of how it was resolved.
8.3. The Customer is entitled in particular to removal of the defect within a reasonable time, a reasonable discount for the duration of the defect (usually as credit; for a Consumer on request also in money), or withdrawal from the contract if the defect is a material breach or is not removed within a reasonable time.
8.4. Unavailability caused in particular by planned maintenance announced in advance, force majeure, an attack by a third party that could not be averted with professional care, the Customer's own actions or suspension under these Terms is not a defect. A Business must report a defect within 14 days of discovering it.
9. ACCEPTABLE USE AND ILLEGAL CONTENT
9.1. The Customer must use the services in line with the law and the Acceptable Usage Policy and is responsible for all content and software in the service.
9.2. The Provider is a hosting service provider under the Digital Services Act. Illegal content can be reported without registration at billing.blazehost.cz/abuse; the single point of contact is [email protected]. The Provider informs the Customer about every restriction with a statement of reasons; an objection can be filed within 14 days to [email protected].
10. LIABILITY
10.1. The Provider is liable for damage caused by breach of its obligations to the extent set by law and these Terms.
10.2. The Provider is not liable for damage caused in particular by the Customer's content or software, loss of data the Customer did not back up, unauthorised access resulting from the Customer's insufficient security, outages of third-party networks and services beyond the Provider's control, force majeure, or suspension or deletion of a service under these Terms.
10.3. Towards Businesses, the Provider's total liability for damage arising from one contract is limited to the price paid by the Customer for the affected service in the 12 months before the damage occurred; the Provider is not liable for lost profit or indirect damage. The limitation does not apply to damage caused intentionally or by gross negligence or to harm to natural rights of a person.
10.4. Towards Consumers, the Provider's liability is not limited beyond what the law allows.
11. CHANGES TO THE TERMS
11.1. The Provider may reasonably change these Terms, in particular due to changes in legislation, the scope of services, technology or security requirements. The Customer will be informed by email and in the client area at least 30 days before the change takes effect.
11.2. If the Customer disagrees with the change, they may terminate the contract before the change takes effect without penalty. A Consumer who terminates for this reason receives, on request, a refund of unused paid credit (free credit is not refunded). If the Customer continues using the services after the change takes effect, the new version applies.
12. OUT-OF-COURT DISPUTE RESOLUTION AND SUPERVISION
12.1. A Consumer has the right to out-of-court resolution of a consumer dispute. The competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce), ADR department, Štěpánská 567/15, 120 00 Prague 2, [email protected], https://coi.gov.cz/informace-o-adr/. A proposal may be filed within 1 year of the day the Consumer first exercised their right with the Provider. The Consumer may also contact the European Consumer Centre Czech Republic (www.evropskyspotrebitel.cz).
12.2. Supervision: consumer protection – Czech Trade Inspection Authority (www.coi.gov.cz); trade licensing – Municipal Office of Prague 16, Trade Licensing Department; personal data protection – Office for Personal Data Protection (www.uoou.gov.cz); Digital Services Coordinator for the Czech Republic – Czech Telecommunication Office (www.ctu.gov.cz).
13. FINAL PROVISIONS
13.1. The contract is concluded for an indefinite period, with services prepaid for individual billing periods.
13.2. The contract is governed by the law of the Czech Republic. For a Consumer habitually resident in another EU member state, the protection provided by the mandatory provisions of the law of that state is not affected.
13.3. Disputes with Businesses are decided by the Czech courts competent according to the Provider's registered office; a Consumer may file an action with the court competent under the law.
13.4. Technical support: [email protected], tickets in the client area (https://billing.blazehost.cz/ticket) and Discord (https://discord.blazehost.cz). Billing, complaints and the Provider: [email protected].
